AT&T, MCI, Others Sue US West Commun Over Qwest Mktg Pact

WASHINGTON (Dow Jones)--AT&T Corp. (T), MCI Communications Corp. (MCIC) and four other parties filed suit in a Seattle federal district court to stop U S West Communications Group Inc.'s (USW) marketing alliance with Qwest Communications International Inc. (QWST).

In a press release Wednesday, AT&T said the suit alleges the marketing alliance violates the Telecommunications Act's restriction against a local telephone company providing long distance service while its monopoly remains intact.

As reported, under the deal U S West would market Qwest's long-distance service within U S West's 14-state region.

AT&T said the suit alleges U S West's "Buyer's Advantage" program also violates federal regulation prohibiting a Bell company from discriminating in favor of one long distance carrier over another.

Joining AT&T and MCI in the suit are the Association for Local Telecommunications Services, McLeodUSA Telecommunications (MCLD), ICG Communications Inc. (ICGX), and GST Telecommunications Inc. (GSTX).

AT&T said the suit says if the U S West-Qwest alliance is permitted to proceed, it will cause "substantial and irreparable harm to long distance carriers, other carriers seeking to enter the local market, and to the public interest."

As reported, under the alliance, Qwest will pay an undisclosed fee to U S West for each customer it signs up for Qwest service, and Qwest will give the Denver Bell's customers low-priced long-distance service.

The Telecommunications Act, which was signed two years ago, bars a Bell from owning and operating a long-distance business in its territory until it opens its local-phone market to rivals.

AT&T said Qwest has projected it could obtain up to $200 million in annual revenue in the first year of the agreement, and that up to 35% of customers in U S West's region will likely purchase the service.

The AT&T suit says US West has defended its alliance by essentially arguing it is not really "providing" long distance service because it's not operating the facilities but is merely marketing another's service.

The suit says that argument has been rejected in previous court rulings.

Representatives for U S West were not immediately available for comment
