Microsoft sees no merit to Sun motions (05:04 PM ET 05/12/98)
(http://www.infobeat.com/stories/cgi/story.cgi?id=2554118387-d4a)

From the article:

"...Based on what Sun has said publicly about the papers...there is no merit at all to Sun's preliminary injunction motions,..."

"...Microsoft is in compliance with its contract with Sun,..."

=====================================================================
I guess SUNW will let the judge determine that. Let's move on and if SUNW believes pure "JAVA" needs to be upgraded on every Windows98 machine then send users an upgrade that provides for this....free of charge. This can be accomplished by providing a down load site on the Internet (like Netscape), mail out CD ROM upgrade disks to all registered users, or provide an "800" line for users to order the upgrade software.

SUNW should address this head on with the users and provide the "pure" JAVA upgrade at Sun's cost. After the fact Sun can go back to the court to collect direct expenses if (1) the expenses are significant and (2) the court agrees that MS has damaged SUN and has violated their JAVA license agreement. If not reimbursed, then charge this expense off to general marketing expenses.

I see this as a win...win proposal for SUN but agree with previous posts that SUN needs to move forward and should continue to be proactive on marketing it's "Pure" JAVA standard.
