The point being alleged is that the patents were obtained fraudulently.
If that is the case, they in law and in fact will be invalid and unenforceable. What VISX's competitors have to gain is not relevant.
The patents simply would be found never to have existed.

We are currently looking for a patent atty to do the evaluation. I can't figure why the FTC started the patent issue unless they have a reason to believe that they have basis. They could have just filed the PPP suit for restraint of trade. Tried to get them to talk. No chance.
