At any rate, if Microsoft goes the regulatory route, which, by every indication, is the route they are going, what is to keep DOJ from coming back in two years with yet another long list of demands?

You KNOW that Microsoft's harshest critics will never be satisfied with anything Microsoft is likely to agree to in the way of restrictions. Indeed, they've already started saying so.

"Whatever goes down as a settlement has to be broad-based and structural," said Raymond Lane, chief operating officer of Oracle Corp. "It needs to be along the line of a Microsoft commitment to a fundamental change in the way they do business. Anything less is going to be absolutely meaningless."

So, they'll just let things play themselves out in this round of concessions, then come back and ask for another round of concessions in a couple of years after these concessions have shown themselves to be less than satisfactory. And so it will continue, year after year, until there's nothing left of the old Microsoft to regulate.
