Kurt,
I believe that what you're saying is close to what is happening, though not using the same criteria.
Both RMCW and RMIL have gone ahead attempting to secure financing if the $10MM investor/lender cannot fullfil his contractual obligation next week.
RMCW is going full steam ahead to finalize the merger on behalf of the interests of the investors on the private side, and RMIl has gone ahead in the case RMCW is unsuccessful in obtaining financing. I hear both sides have been very successful in this area and we should hear the results/details soon!

IMO it is not in the best interests of RMIL to trade at this time as I think we will see a scenario of shorters trying to send this to oblivion unless there is some remnants of a thriving viable company, which will make it much more difficult to do with the SEC watching.
