I disagree that its not MSFT's fault they own 85%( actually I think its higher) of the OS market. Of course its their fault.They run a very successful business, and their goal should be to own 100% of the market. All business's have that goal.

The problem with the DOJ involves how they go about doing this. For instance, in a previous post it indicated that they require payment for licensing fees for all computers sold, regardless of whether they use MSFT or not. I think that would raise a red flag to the DOJ. Why should a company be forced to pay MSFT a fee for a computer with an IBM OS? And what force is being used? This gets back to those rumored "secret contracts" that MSFT has used to make its OS vastly dominant. The threat of losing their license has always been a sticking point.

I think the statement on CNBC yesterday sums up a lot of the problem. MSFT wants free reign to contantly use their OS for what they call innovation. Constantly including more and more stuff in the OS, and in the process blurring the line between OS and Apps.
The DOJ on the other hand is concerned with making sure that the OS does not stop competion regardless of the innovation. They feel that innovation is created by direct competion. So they worry that MSFT's dominant position is so large that competition, and hence innovation, is effectively stopped.

The two are very different, almost opposed, views. How these will be resolved will be interesting to watch.
