Kailash, the DOJ had been expected to file the suit earlier this week and then came the 11th-hour negotiation which put the suit and the release of Win98 on hold. The fact that the talk has broken down and lawsuits will be filed on Monday is not an unexpected event. I don't think we'll see black Monday because of this new development. On the other hand, the market will surely rally strongly had an agreement been reached.

But then again the latest developments in Asia may help make sure the Fed keeps rates where they are making the bull take off again. I am still about 70% net short so a bad Monday would be good for my spirits/pocket.
