is it really that the law's interpretation is 'changing' in that something which everyone did before will now be illegal-- or is it that nobody has done the sort of stuff that Microsoft has done to the extent that Microsoft has done it?

Could be either or both. We'll see when the DOJ files their case.

Kind of like how the meaning of Constitutional amendments expand with the times?

Actually, this is an excellent analogy. That's why Lessig's writings on the meaning and method of interpreting the constitution are so important, to give just one practical ramification of the analogy.
