For myself, I regard the application of new patents as not only a non issue but a red herring.

As a developer of technology, you are both morally and economically obliged to patent all new findings, and improvements. That is all that this new "Mark II" is: an improvement on the old plant technology. According to the agreement, TPP is entitled to all improvements on the thermophillic plants as has already been ruled by the courts. That the improvements are patented, do not negate the terms of the agreement.
