Jesse Berst weighs in again, he's not impressed by the Microsoft defense strategy either.

I've talked about Microsoft's failure of leadership in the past. Click for full story. I could talk about lots of other mistakes. About its foolish failure to negotiate over the past year. About its unscrupulous scare tactics. About its eleventh-hour brinkmanship. About its distortions and exaggerations.

But for right now, I'll confine myself to Microsoft's blindness. At least 15 states plan to join the action. The attorneys general of these states didn't jump on the bandwagon because they thought they'd lose. They examined the evidence and decided this was a high-profile case they could win.

I remember how the tobacco companies scoffed when first sued by a state. "So sue me!" they sneered.

Much the way Microsoft is sneering today.


Lotta sneering going on here too, if you can't get enough there's a near limitless supply over on "How High". It may be beyond the comprehension of mere mortals, but mere mortals will probably decide the outcome anyway. Make their own judgement on the sneering, too.
