The Class lawsuit action arose from the consolidation of more than THIRTY separate anti-trust actions filed beginning in May 1994 in federal and state courts throughout the United States. The assertions against the CEOs (as we all know was filed) is just the tip of the iceburg! The Complaint alleges that the defendants and other successfully conspired to increase and fix the "spread" paid by plantiffs and the member of the Class in connection with purchases and sales of Class Securities.

The other charges are even more involved. It is conservative to say that VVUS is not totally out of hot waters yet and that the Suit (if they are directly involved or knew about it) will drag on and put doubts on the minds of any new money! All the lawyers need now is for any of the first defendants to start singing as a plea bargaining attempt.

Even if VVUS is found not guilty! The damage to credibility may last for a long while. Recent example, check out ESOL and you will see a stock that has remained FLAT at $4 to $5 for ever. Usually, a year plus!
