One of the things the court considers in granting an injunction is to prevent the defendant from causing any further "irreparable harm" to the victim/NSCP. ie, if the factory is blowing out toxic smoke to your house, you don't want to wait until the litigation is resolved, you want the court to stop the smoke first, then the litigation on the merits. NSCp's press release this afternoon is essentially saying "thank you, DOJ, but this is too late" How is the court going to issue the injunction if the victim is saying that the irreparable harm has already been done?
