Sort of. Some stocks can dip below 5 and still maintain their marginable status. Then it's up to your broker. Sometimes you can negotiate a short sale below $5 with them. I also thought you could short some listed stocks below 5, but I don't think I have ever tried. I don't short too many NYSE listed stocks so I am not sure.

One of the last small cap NYSE stocks I shorted was ZE. Too bad I left 14 points on the table, I hear ZE is going to get booted of the NYSE and trade on the OTC-BB under the ticker symbol ZERO (only kidding <g>).
