In the current state of produceable wireless technology their patents are broad enough that in my opinion there is no way around at least one of them. As technology advances there are always those that find a better mouse trap. These people may not use the QCOM way but remember that QCOM is also not a stationary target. QCOM is I am sure continuing research into CDMA or something better, after all that is where their roots are, research.
