Rejection of Liability protection:

The Goal here is to defeat the Mcain bill. Many Senators who are opposed to any excise tax voted to eliminate liability protection. Why? The bill now becomes unsupportable to many Senators who previously supported it. It's an old-fashioned strategy called " divide and conquer". Other amendments are being proposed in the same light, like using the money to eliminate the marriage penalty. Don't underestimate the strategies going on here. Some of these Senators are real shrewd foxes. As for the vote, there was nothing absolutely binding in it. The issue of liability protection will come up again.

The G.Black rpt., provides additional insight on issue

Senators do not wish to be accused of tax increases.
The ad campaign tactic by Tobacco co's seems to be
striking a very sensitive point.

The last thing that Republicans wish to be blamed for,
is raising taxes.

my opinion, the Tobacco companies should attact more
vigourously with the TV-Media blitz, small secondary.
mid-America full page adds, National campaigns,
as an aside, some networks will reject, the ads,
I predict, i.e., Turner's Fox ...his wife...what schmucks!!

This is not to endorse, the June agreement, I think that was
not fought well, however, no point in crying over spilt milk.

I am buying, next week, between 36-37

Remember, a vast amount of capital awaits, an end to the
future legal liability acts, particularly, the class actions.
