Appreciate your comments. A few responses:

1. Re. Blumenthal - he is not a person trying to make a name for himself. He already has made a name for himself and is very well respected. If anything he is putting his reputation on the line by taking on this case - there is more risk to him than reward, so this is obviously something he believes in only after considerable deliberation.

1a. A comment was made earlier about $ - the states are not taking on this case for money. If anything, the state budget (at least for Ct) is better than its been for a decade - running a record surplus.

2. As I learn more about this, the case is really about the new monopolies and what their limits should be - ie to what extent msft can use its OS monopoly to dictate Ts and Cs to computer makers, whether msft tried to use its monopoly power to divide the browser market with nscp in a meeting a few years ago, and whether consumers can make free choices about browser software. There is a very large disconnect between msft and the govt on this. This case will ultimately play out in court - not in public opinion. It is not a case of "innovation and apple pie" versus government intervention. It is a case of strong armed Ts and Cs versus the publics right to chose. While not a legal expert, I try to have an open mind to arguements having recently served on jury duty. Imo, based on what Ive heard thus far and based on the integrity of some of those on the govt team, msft will lose this case.
