WTDEC......Regarding potential patent problem,
isn't it true that most biotech patents face the "test"
in court on patent infringement? It seems like Roche would need concrete damages to have a base for suing...i.e. when another party starts selling their product.

A patent can be issued but found to be invalid in court. (I'm not suggesting LGND would have a problem here..but these suits can be very expensive). I believe it's a jury decision in the initial patent infringement suit (as absurd this sounds) so most decisions go on to appeal...decided by a panel of judges.
