There are a lot of DIVX enemies, particularly on the DVD bulletin boards and web sites. The two biggest drawbacks I see with DIVX are: (1) privacy and (2) easy transference of your disks.

First, who wants their buying record in the public domain ... I don't particularly care but several friends have said it smacks of Big Brother. The requirement of a phone line makes things worse.

More importantly, though, are the problems with using a DIVX disk you've paid for infinite plays. Initially, it seems that you can only watch the disk on players registered to your account. So this would seem to prevent you from (1) loaning it to friends or (2) selling it. Recently I've seen something called DIVX "Gold" that could be used on all players, but I've got no concept how they could implement it.

In any case, NMBS makes money in the short term regardless of how DIVX does. In the long term, NMBS makes more if DIVX flies. At least with DIVX finally getting out in the open, people will have all the facts and finally commit to some kind of purchase, either DVD or DIVX.
