>DEC went after INTC... settled without a whisper.... to short a stock in hopes of a settlement makes no sense to me... given this sentiment... one should short almost all stocks...<

CML: In general I agree with you, but IMO the DEC example is not a good one. Perhaps INTC did not pay as much as it should have for stealing DCE's alpha chip blue prints (IMO they did), but they did pay good money/made significant concesions and their financials are still suffering and will continue to suffer from it. The lawsuits are not the only reason why I shorted AVEI.

My post to you originated from your statemnet regarding finding green cheesse in the moon which IMO understimates the probability that one or more of the several pending litigations against AVEI will be successful, at least in part. From the number and tone of the lawsuits I gather the folks at AVEI are not what I would call ethical pussycats when it comes to business. Does not strike me like the kind of company I would like to do business with, but then again neither does MSFT.

PS: thanks for the civilized reply, longs are usually so scared by the prospects of someone shorting their beloved stocks that they forget any manners they may have learned throughout their lives, While in fact the opinion of shorts in several stocks I have been long have proven right (not trying to imply I am right I am assessment of AVEI)
