I wonder if it's discriminatory to hire only skinny women as models.
I could imagine a fat woman using the Americans with Disabilities Act to kick some butt.

Alex, people who work in bars tend to be unqualified for jobs which require more skills. So there is a real question as to whether they are really giving free, uncompromised consent when they waive their rights to clean air, and whether they themselves smoke is irrelevant to that argument. They may be acting on short-term desperation, rather than weighing all the facts in a reasoned way. The state also has an interest in creating and maintaining reasonably healthy workplaces, in the interest of public health.

So while it may or may not be discriminatory to hire only smokers, I don't think it solves the larger problem of second hand smoke in the workplace.

Alex,

A while back, I proposed that we tobacco addicts get ourselves classified as disabled. After all, we ARE addicts.

Back in the good ol' days, a friend who owned a small business (not a restaurant) always made it a point to light up during job interviews to see how the applicant would react. The majority of people who worked there smoked and were highly desirous of preserving that freedom.

Alex:

I wonder if it's discriminatory to hire only people who can do the work?

I wonder if it's discriminatory to hire only people with brains?

I wonder if it's discriminatory to hire only humans?

Cheesh. . . this could go on forever.

When is America going to get some guts again?
