Dear Mantle, et. al: Any statement I have made on this board have been already made in sworn deposition or sworn pleadings in Cause No. 97-26443; David P. Summers and Dorothy H. Summers v. American BioMed, Inc., Steven B. Rash, Claudio M. Guazzoni, and Lawrence Hoffman; In the l33rd District Court of Harris County, Texas. In addition for pleading for recovery of accrued personal saleries, repayment of loans made TO the company and personal shares either loaned by my wife and/or me to the company or escrowed on behalf of the company we have also included a SHAREHOLDER DERIVATIVE SUIT ON BEHALF OF ALL SHAREHOLDERS to resend certain actions taken by Rash and the Board of Directors subsequent to January l, 1998.
