You can always short this stock,and any other stocks >$5, in Datek. Yes, they allow you to short the shares that are not even there. Look at what happened to KTEL! Its short interest is even bigger than the number of float, maybe several times of bigger. Go figure.

However, this kind of pyramid short is not necessarily bad for the longs.

I spoke to the SEC today in regards to possible manipulation of Vivus stock.

Way to go, VLAD! One skillful phone call can make a difference.
