Ericsson does not claim any rights to QC's IPR. Rather it is claiming that several elements of IS-95 infringe ERICY's IPR. This is an important point of differentiation, because it means that even in the event of a "blow-out" in court, Ericsson would still need QC's IPR to do W-CDMA.
