Barry, as a lender I would lend against assets, and in this case I would probably lend between 50% to 70% of the construction cost of the new plants. I would not particularly worry about the trial outcome, since I would have first "grab" on the facility if TTRIF was somehow damaged financially by the court's decision. Please do not conclude from this that I have turned even mildly positive on TTRIF. They still need to finance the part which is not financed by the banks, and of course, the bank, if it is so inclined (getting cold feet) can always use the court action to withdraw.
