Crossy, good point on the confidential part. But,,, I think they can only insist on confidentiality for a given time frame; not forever.

This is a common practice among most all companies while in the process of on-going negotiations. It will not last forever.

You are over inflating the issue. DF-144 like most all
patented items has the potential of being reverse
engineered. The concern on the part of Arcon is not with
the results. If they thought the results were going to be
unsatisfactory they would have never agreed to the test in
the first place. A company like the big E with all their
research capability can surely make a Harvard level attempt
at figuring out what the stuff is. On the other hand,
Arcon just can't hand them a can of DF-144. It is not that
easy. There also needs to be some technical know-how transferred
in using the magic potion.

If I were the Big E I would most certainly test any product
in the market. That is their job to be aware. Don't read
too much into the Big E testing. The key here is the beginning
of the production and revenues.

Anything short of revenues is just hype and we know what
happens with that.

1) Most importantly is to get rid ot the AUTO-CONVERT clause of the MIDLP this October. This auto-convert is dangerous for holders of all 3 MIDL, MIDLW and MIDLP alike.

I agree and you and I will talk since we seem to have both sides of the issue cover. I think maybe a optional conversion starting in Oct 1998 to Oct 1999 with a dividend to the long term holders of MIDLP that do not wish to convert would be a good midpoint. What do you think?

2) I personally have a "problem" with the condifentiality agreement regardinx XON. Ok, I perceive this is the way business is done in this area. But how the hell do we find out that XON likes DF-144 ?

Well like any other business they want to keep it tight to the breast and silent as much as humanly possible. Why should they announce anything till the testing is complete? They will release the results probably but other than that I would suspect they do not want that much competition on their own money testing the product.

I could be wrong but the confidentailly agreement I do not see as a negative but smart ..
