NEW YORK (CNNfn) - The Federal Trade
Commission's top litigator has recommended that
the commission sue Intel Corp. for alleged
antitrust violations, sources familiar with the case
said Tuesday.
The recommendation by FTC competition chief
William Baer opens the way for an antitrust suit
against the world's largest chip maker, the
sources said.
A source said the commissioners are likely to
vote on the recommendation early next week.
The FTC has argued Intel illegally used its
monopoly power by arbitrarily cutting off technical
information to competitors, preventing those
companies from shipping their products on time.
Neither the FTC nor Intel would comment on
the recommendation.
Intel and the FTC have been in talks for about
10 weeks, during which time Intel has presented
its case to the FTC's commissioners as well as
Baer.
The FTC has handled the case because the
Justice Department's antitrust division is tied up
with its suit against Microsoft Corp.
News of the action had no adverse effect on
Intel (INTC) shares, which were up 1-1/16 to
69-1/16 in afternoon trading.
