Swan, the owner of Danielle Cheese Distributors, Inc. of Goshen, New York, seeking to enforce Swan's specific performance of an executed contract dated 15 January 1998, whereby Araldica purchased 100%- of the capital stock of Danielle from Swan................ As I recall from my business law class, a suit is not filed in the state supreme courts until a ruling in that suit has been found in a lower court. Have I missed a suit against Danielle and Jon Swan filed in a lower court? How is it that the lower courts be circumvented in this case? Are there any lawyers here who might clarify this?
