I think the price only needs to be above $5 when the application is placed, it can fall below that later and not disqualify the company. FIBR was above $5 when the app was filed last year.

That assumes that the only complaint that NASD has is that the share price is below 5. We have no indication that this is the case, and I doubt it. FIBR refuses to comment on the matter, but I suspect that it is directly related to forward-looking comments made earlier by Par Chadha, which have not come true.

I feel that the NASD is also to blame in this matter, and I would like to see them hit with a class-action suit. The NASD supposedly has an interest in protecting investors, but their secrecy and refusal to comment contributes to investors being in the dark. I should have never invested in any NASD stock, and doubt I ever will again. There are so many good stocks on the NYSE, that there is no need to gamble money on the NASD, where they allow illegal manipulation, and where they operate in secrecy and refuse to protect investors.

What is this obsession with NMS listing? What actual benefit to the shareholder would be derived from it? It's not like the stock is invisible or you can't trade it.
