The press release with Exxon testing contains this blurb about EPA registration of DF-144.

They have an EPA registration which is required to sell DF-144. I do not know if they need approval or not. This is a requirement and I do not think Exxon would be testing something spending tons of money that would be unsellable because of a non EPA registration. Exxon would have checked the patents, registrations and all before requesting this product fo testing.
