Joe: What does the letter from Smith and Uhrs say? Whose the plaintiff this time? By the way, since you say you were not in charge of litigation, I presume those who are were not able to put up a meaningful defense or counter suit and have had to take the hits. Specifically, what are the reasons you believe my presumption is incorrect? Didn't you participate in and negotiate the agreement with Leone? Isn't it a fact that in the Leone Agreement it provided that Leone would receive a full fee if he did anything to raise capital? When Leone was not able to raise capital you urged non payment of the fee just because you did not want to admit that you screwed up? Come on, you were right in there with everyone when all these matters were going on from inception to conclusion; don't wrap your self in the mantle of an innocent bystander now. It won't wash.
