Well it all depends on whether the liability of the
host service is strict or unlimited.

Prodigy monitored it's posters and painted itself in a
corner in that a liable post became THEIR responsibility.

Bit If you DON'T police and allow all then you can claim
it's NOT your affair.

SI is making the same mistake by suspending posters
on occasion. Making it a monitored service and all
liabilities apply.

It is their funeral.

The precedent is the strip club decision in the CDN
supreme court and the Prodigy case where they could
not claim that they were not responsible for posters
content as they monitored it and occasionally enforced
standards.

The paradox is that to be a s--t about it and let the
four winds blow is better to avoid touble but SI,
although legally trained, doesn't get it.
