Now granted I have never had first hand experience in a stock loan department, but I think this is one area where a Broker Dealer can play a little hanky panky.. Does Datek make markets in securities?? I understand they have their little Island trading system, but I bet they make markets as well. In any event, if they make markets, the trading desk can be short almost indefinatly....

Yes there are certain ratios that they are supposed to be meeting concerning stock positions and client accounts, but they are reviewed as a total picture. Not on an individual account basis and it is up to the Broker Dealer to report when they are out of wack.. My guess is that Datek is walking a very fine line when it comes to their stock loan policies.. They appear to be far to liberal. At some point this has to end.

Think about it, how could one firm consistantly have shares to short when no others appear to??

In the mean time, maybe I will fund my free quote server and take advantage!!!
