I am also wondering if QC can somehow link ERICY's strategy on the 3G issue to the unfair competition lawsuit currently scheduled for trial later this year.

Gregg has already responded to your questions/concerns, but a few quick points:

ERICY says they don't need it. If this were true they would not be making such a fuss about it. Given the track record of both companies, the choice of who to believe seems a no brainer to me.

You would only build a CDMAone network under these circumstances if you were fairly certain that WCDMA could not be done without Q and that even if it could, you're willing to foregoe harmonization and all that it conotes... Disagree. You build the network that will deliver the lowest overall cost structure for expected capacity and service offerings. You probably want a clear migration path to high speed data in the future. Under the circumstances you proposed, would you buy a GSM system knowing that to get to high speed data you must count on (now) untried technology (the hinted at "workaround") that may or may not be available to you when you want it due to legal delays, and even if available you may be drawn into IPR litigation?
