Well that sounds like you are saying that Cashco would maybe still go forward with an unmeritorious case just as a tactic to silence Janice for expressing her opinion. Because the inconvenience of it is just too costly. That would be a feather in their cap now wouldn't it? You just can't pay for publicity like that. (Mark Cohen to IR stat!)

Meanwhile the stock price is doing a swan dive like in Trainspotting. It seems that the 20&cent's support level is non-existent.

I agree that a judge might have to preside over the process used in the discovery phase; what is acceptable and what is not. In my opinion, anything that might have bearing on the suit would be found acceptable, including virtually all company documents. Your post also assumes that the legal action takes place in Canada. Perhaps true; perhaps not. We'd have to wait and see.

I'm sure that Janice has many friends, each of whom could help financially in some small way. Little drops of water soon fill the tub. If you and I were attorneys (but we're not, are we?), we'd be playing a game of chicken right now. Who do you think would blink first?
