If you read that entire document you are probably aware that the wording is such that Vivus mentions all possible negative scenarios and not just in regards to the financials.

They don't want to be sued again for giving any type of bullish perspective.

- first message didn't go thru - hope I'm not repeating

- but all disclaimers in 10k's are worthless.

- e.g. Microsoft always qualifies theirs by talking about competition & market saturation.

- I just don't think that the company is in as much trouble as the stock price suggests.
