In case you have not read, Phillip services are battling some posters from a
Yahoo forum dealing with that company. As well, Porter Davis, an 18-year veteran
of options trading and member of the board of the Toronto Futures Exchange whom
has done some posting to one of the SI ( Silicone Investor ) forums, and has
subsequentally been threatened with a libel suit if he did not stop. The details
are in todays Financial Post, page 1 and 5. Anyway, there are 2 different types
of defamation. Slander, which is verbal, and libel, which is written. Obvioussly
libel is the one that deals with net groups. If you accuse someone of anything,
you better have the solid proof to back up your claims. If you do not, you are
exposing yourself to a libel suit. If you think that they cannot possibly find
out who you are because of the cloaking of the net, you are wrong. However, if
your claims can be proven to be true, a libel case is not likely proveable. Here
is an excerpt from one of my law books that deals with some of the claims that are
made here, obviously without research or merit:...If a person makes a false
assertion of fact with knowledge of its falsity, or at any rate without an honest
belief in its truth and with the intention to mislead some other person, the
misrepresentation is fraudulent and amounts to the tort of deceit. A victim who
relies reasonable on the assertion and suffers a loss may recover from the
wrongdoer....

In short, most of us are here to find out more information on companies in which
we invest in, or plan to invest in. Not all people are sceptical, and in fact,
some are down right gullable. If anyone thinks for one minute that the information
provided within these forums will make enough of a difference in a market for
them to profit from, they are mistaken. These forums are read by a number of
people vastly greater than appears, which should be evident by the recent
responses to the NIR thread on SI. (David Carlson, Owen Hoffman) most people check
out clouded claims. Then their results are generally posted. So, those of you who
are violaters of these principals, please save everyone their valuable time and
stop posting trash. They only annoy people, then they stop reading your posts.
