If they are allowing shares to be shorted that they don't currently have in marginable accounts, to be legally lent out, then I would think that would violate the regulations or laws that pertain to short selling.
I am not a securities lawyer , but I know that a short must have a borrow, and I'm merely saying it is quite odd if only one broker/dealer in the entire country has shares to lend.....since I have no firm knowledge one way or the other as to Datek's position , this is merely for discussion purposes , not an accusation. Food for thought.
