Bre-X Minerals Ltd - Globe says no duty to reveal Busang results, claims Barrick Bre-X Minerals Ltd BXMShares issued 2191033301997-05-07 close $0.09Tuesday Jun 16 1998See Barrick Gold Corp (ABX) In the News The Globe and Mail reports in its Tuesday, June 16, 1998 edition that in a motion filed yesterday in a Texas court Barrick said it had no obligation to disclose results of tests that indicated Bre-X Minerals' Busang gold property had very little of the yellow metal. The Globe's Paul Waldie writes that, "A corporation such as Barrick has no disclosure obligations to the shareholders of another corporation. The 'mere possession of non-public market information' does not give rise to a duty to disclose. Moreover, 'a corporation is not required to disclose a fact merely because a reasonable investor would very much like to know that fact," Barrick said, quoting from another court decision. Barrick's motion is seeking to dismiss allegations made against the gold company in a class action lawsuit filed in Texas. The lawsuit alleges that in the fall of 1996, Barrick tested 135 samples from Busang and 130 contained no gold.
