If my memory is correct the judge refused to force an injunction on Q because he thought that the clamshell design was not something that is protectable, and that the Q phone was in any case different enough. I think that the analogy used at the time was the steering wheel. Just because H Ford used it didn't mean that GM couldn't also use it. After all, one could in principle steer an auto with levers, pedals, strings.Anyway, I'll look for the press release and post it.

I'm wondering if you know whether patent holders are allowed to withhold the right of others to use their patents to test new products, such as ongoing ERICY WCDMA tests, or whether ERICY would actually have to mkt a product which infringes before they would be in violation of the law.
