>>...you can't short a stock below the $5.00 level so we are almost done with the short pressure...<<

Bull hockey crap! Where do you people come up with these mis-information??? Only Datek does not allow you to short stocks under 5 cause you dont get margin on penny stocks! Use a real broker. You can even short stocks under 1 cent.

VVUS a PENNY STOCK by friday! I am taking bets to offset some looses..

- Dr. Andrews - I agree totally with your analysis.

- Which is why I'm not too nervous about my Vivus holdings.

- I'll take a 2,000 or 3,000 a week scrip in 30 countries.

- Let's face it. Vivus never sold more than 15,000 scrips a week. But with approvals in new countries coming fast & furiously, it's jusst a matter of time before we exceed those numbers.

>> you can't short a stock below the $5.00 level <<

This is erroneous information. My broker, Merrill Lynch, lets me short any stock, as long as I have the funds in my account to cover it. If a stock I'm short on runs up 100%, I had better have the funds available to cover it.

<<Good News ...you can't short a stock below the $5.00 level so we are almost done with the short pressure>>

No, this is incorrect.

I'm just a little retail guy, and yet off the top of my head I can tell you that within the last month or so I've shorted LOCK at $4 1/32 and PNDA at $4 7/8. You just have to put up more collateral than normal and it's a little more difficult to get a borrow, but I assure you it's commonly done.

Mr. Andrews: Thanks for responding. I have shorted some stocks in the past, and provided I had sufficient funds in the account, and a "track record" with the brokerage, e.g., promptly meeting margin calls, there seemed to be no barrier at the $ 5.00/level. I saw a post on this thread regarding Merrill Lynch (sp), and from a friend who is a broker there, they do allow a customer to short, however they may want additional margin funds in the account before doing so. FWIW, the past two days trading in VVUS have been very interesting from a technical standpoint. We'll see what the rest of the week, and options expiration have in store. Regards.
