Re -- LU will have to prove CSCO violated..

In a court case, the defence will mount an attack of proving that they did not violate the patents. But of course this is speculation, because some defences just lie down and take the attack.

The case is tried to a jury if one of the parties files a jury demand. Otherwise, the case is tried to a judge. In cases involving complex technology questions, the judge may appoint a master for fact finding, as was done in the Microsoft litigation.
