I thought the application for the patent was already filed by the person that came up with the formula in the first place?

That is correct and that is the original inventor in Kentucky. However that is not what John is applying for according to John

That's what's been said in the past,was it not?

I do not understand this except that at the time of merger Arcon had the rights to the patents of the original inventor. Now whether they did, do , or not I can not verify for I have not seen the audit or the articles of merger

Patents are not pending until applied for

As I understand patent filing procedures once that has been done you have to wait until the application is approved and a number is assigned before the patent legally belongs to the applicant. After that the patent can be assigned to who ever.

Have I been misinformed??

I do not think so but there appears to be more patents than people are aware
