troy,
the only comment I have is that I know for a fact that morality becomes an issue to the judges who set on some appellate death penalty cases

it isn't a issue for a lawyer to argue(although some say you should if a particular kind of judge is on your case)

but it is an issue when it comes to making up a particular judge's mind on his vote on a death penalty case

I know lawyers who curse if a particular judge shows up on the appellate panel....depending on the kind of issue...each judge is known for something and when you are arguing a case, there are some cases where you dont want a certain kind of judge

as judges make decisions in all kinds of courts..their personal views come into play..whether it is about the attorney, the case, the people involved..etc. etc. etc.

and if you have never practiced before those kinds of judges......you are extremely fortunate...

as far as the morality of the death penalty
I have no opinion
but there are many people that do..including appellate judges...

and I have nothing else to say here

I have my opinion about what I see and what others have told me about Judge's personal views effecting decisions and court cases

and you have yours

Troy,

Let all the world know: I have been wrong in the past -- at least once - although I can't quite recall when...:)

I once thought I made a mistake. I turned out to be wrong! ;O)
