Although I'm no lawyer, this is the way I understand the favorable interpretation of the lifting of the restraint:

The logic being that any profits garnered by MSFT as a result of the release of a Windows 98 that includes IE as the default browser would be seen as "liabilities" should the justice department prevail in ROUND 2 of litigation. Since a preponderance of the damage inflicted by Windows 98 is in the internet browser arena, NSCP would be the primary beneficiary and would then be free to pursue civil litigation of their own seeking damages and punitive damages (3x damages amount) with respect to profits "lost" to Microsofts IE..... Go Microsoft!!!!!
