MM's can short any stock any time and is a necessary function, thats what provides liquidity in the market.
Abuse? No question about it.
The normal function is for the MM to short uptrends and buy on the pullbacks. He must buy on the pullbacks and thats what makes the market work. We are the only country in the world with this system. The man in the middle takes the risk and makes a profit. Other countries the buyer and seller match up, in a lopsided market the stock doesn't trade, no buyers, no sellers/ no sellers, no buyers.
Our system is better. Abuse? BB stocks are easy to manipulate because
no one is watching.
Coz
