Bill, since that silly and frivolous lawsuit looks valid to you, you and Fuchi really belong in the mental hospital.

When a company sells a product with a specification, that mean this company guarantees this product to run at that particular specification which most likely that product is tested to that specification. For example, when you buy a generic dual operational amplifier, LM358, this part is rated at 0øC to 70øC. You can also choose to pay a little bit of money to buy an LM258 which is rated at -40øC to 85øC. Wait, there is one more. You can also choose to purchase an LM158 which is rated at -55øC to 125øC. All these parts are functional identical (some manufacturers may guarantee a lower offset voltage for LM158 and LM258).

In this case, the whole consumer industry is in big trouble. That would effectively halt the world economy. Not just Intel is in trouble, AMD is too!

In your case, that is totally illegal and unethical to ship products to your customers with NEC/400nSec parts when they specified 150nSec! As a manager, you really have failed in that position, sir.
