Just some interesting comments I saw on MM's. Applies to NASDAQ, not bb's, re: short reporting. Can this help with our apparent "Canadian problem"?

MM's have to report their short positions either on the 15th of the month or on the settlement day immediately following. If the position is underwater they must (in essence) escrow significant funds to demonstrate their ability to cover. They do not like to do this.

However, the entire float must be oversold for this to come into play. If one MM is short and others have inventory, it will be hustled back and forth to make the short disappear on reporting day. Also, if the MM is ahead on his short, no funds need be escrowed.

So, it's tough to make MM's cover, and you may have to keep after it for a couple of months. If solid investors hold a good stock for a couple of months while new buying is comes in, sooner or later they will have to let it go.

If you've got good solid Level II information that can enable you to get specific about a given MM who is playing with your stock, call NASD Regulation at 1-800-208-2098 and file what is called a Regulatory Tip. I did that on ALYA early in the week, and, with the MM's knowing they're being watched, things have calmed down somewhat.

NASD will not comment on your allegations or their investigations, and they won't pay attention at all to generalized allegations. It's not a magic formula, but it may help in certain situations.
