What they tell me is that if u already use COMS equipment that u can get the upgrade,
if u do NOT use COMS equipment then it is not available yet.

It sounds to me like they haven't got the v.90 upgrade yet. If
you get the 56K upgrade to v.90 then it will still be compatible
with the ISP's that haven't upgraded to v.90 provided that
the ISP uses the x2 compatible software on their side and your
modem is an x2.

This is an example of the modem problems. ISP's are not
upgrading fast enough to v.90 to be compatible with all
modems. If you had an 56KFlex modem you wouldn't be
able to connect to your ISP at all.
and vice versa,
you can't connect with x2 56K with an ISP that only uses
56kFlex.
Until we get ALL ISP's upgraded to v.90, there
will be problems that discourage people from upgrading to
v.90 modems. And until more customers are using the 56K v.90,
the ISPs will be hesitant to upgrade on their side.

What's especially strange about your post is that you say,
"They have been trying to get the v.90 ISP upgrade and cannot
get it from COMS".
I can't imagine what would be the hold
up on 3Com's part. I can't imagine that they're backlogged
with orders and have to wait for the v.90 upgrade on their
server side.

I think they're real problem is they just don't want to upgrade
yet
. This might be worth checking out, since you said they
are a reputable name, this could be anecdotal evidence on
why ISPs are slow to make the change. My feeling is they just
don't want to be one of the first to do so. Once they
see v.90 modems in customers hand, then they will upgrade.
Of course, now when somebody buys a computer system, it already
comes with v.90 modem. So sooner or later the ISPs will have
to upgrade.
