Homer,

1)The 'value' used is the value the option would have at 4PM on the third Friday of the month. There is no bid/asked or time premium involved, just how much 'in the money' is it. The calculation method is explained in the example analysis selectable at the bottom of the Max-Pain graph page.

2)I wait until the market has been closed for a couple of hours, and then use the CBOE table data column labeled 'open interest'. I believe this has the day's activity accounted for. For example, If I go and look at the data for SUNW today, it shows the same OI numbers that I downloaded last night at 8PM EDT.
