Fact is that this does happen in our industry. The reason I don't think the lawsuit will amount to anything is that in the case of B&L, it appears that it was a part of their business plan. Not so in the case of CPU suppliers. Yields are not so easily predicted nor is customer demand. I do not believe that AMD or Intel intended as part of their business plan to cross ship fast material, but did so only as a temporary response to unequal binsplit and demand. Intel has dealt with a sustained shift to higher speed material by simply pricing slow material at the same price as fast material, hence no one orders slow material anymore. I don't think the suit will go anywhere but even if it does, I think it will be fairly easy to show there was no intent to defraud, nor was Intel's practices any different from industry norm, as evidenced by AMD own published statements.
